Terms And Conditions Governing Your Hosting Plan / SBH Services Agreement

Section 1 - Definition of Terms

The following words and expressions shall have meanings hereby assigned to them except where the context otherwise requires:

"Silver Bullet Hosting","Silver Bullet Holdings", "SBH", "us", "we" and "our" means Silver Bullet Holdings Limited;

"System", means the computer system, programming and communication facilities required by Silver Bullet Hosting for the operation of the service;

"Service", means your Internet Hosting provided by Silver Bullet Hosting to customers subscribing for the same;

"Client " and "You" means the party or parties who enters into this agreement with Silver Bullet Hosting;

Section 2 - Scope of Services

Silver Bullet Hosting reserves the right to modify, enhance and withdraw the service and alter Policies and Service Guidelines.

Section 3 - Terms of Payment

In consideration of Silver Bullet Hosting providing you with the service, you agree to payment as follows:

We do not offer refunds of less than one month's hosting fees. For new accounts cancelled in the first month we will charge the first months hosting invoice.

If we are forced to hand your account over to our debt collection agency for collection you will be liable for these collection costs.

Invoices will be issued on the commencement of the hosting agreement, and then monthly on the first day of each month thereafter, unless expressly agreed otherwise.

You shall pay on invoice the amount owed by the 15th of the month.

If collection for payment is unsuccessful, you will have 5 working days from notification by us of the unsuccessful collection to make payment, after which your account will be suspended.

Section 4 - Ownership of Designs and Concepts

Silver Bullet Hosting retains ownership of all designs and concepts created during consultation and design stages of development, until payment is made in full for contracted services.

Section 5 - Reselling of Services

You may not either directly, or via an agent, resell part or whole of any account served by SBH without express prior permission. Any client found doing so is in breach of this agreement and may be subject to the immediate termination of any and all accounts.

Section 6 - Validity of the Agreement

Either party may terminate the agreement on 30 working days written notice to the other party.

Silver Bullet Hosting reserves the right to cease immediately without liability (other than for the refund of unearned prepaid service fees) to provide the service and to terminate the agreement if you should go into liquidation or bankruptcy, or if you fail to conform to any obligation in accordance with this agreement subject to our terms.

Section 7 - Liabilities

You agree that Silver Bullet Hosting will not be liable for any indirect or consequential damages including but not limited to loss of profits or for any claim made on the client by any other party even though Silver Bullet Hosting may have been notified of such damage or claims.

Neither party to this agreement shall be responsible for failure to fulfill its commitments in this agreement if such failure is due to any other circumstances outside its control. Such circumstances comprise, but are not confined to, acts of God, war, riots and sabotage.

Section 8 - Web Site Content

You agree to abide by the Policy and Service guidelines and any modification from time to time as may be deemed necessary.

Section 9 - Disclaimer

Silver Bullet Hosting shall not be liable for any damages suffered by any user of these services, nor be liable for any claims or damages whatsoever or howsoever caused, including without limitations to property damage, loss of profits, interruption of business, intellectual property infringement, personal injury, or for any special, consequential or incidental damages, whether arising out of the clients inability to use the service, breaching of warranty, contract, liability or otherwise.

This agreement shall become effective on the date of your order form being submitted to us for the said service, or from the commencement of SBH's provision of services to you, whichever is the earliest.

You shall be deemed to have read this agreement and agree to be bound by this agreement. This agreement shall supersede all proposals or prior agreements, oral or written, and all other communications between the parties relating to the subject matter of this agreement.
